TSC REVERSES ITS RECENTLY STATED POLICY REQUIRING
A VISASCREEN WITH AN INITIAL 1-485 FILING

The Texas Service Center (TSC) has reversed its recently stated policy of requiring a VisaScreen with the initial I-485 filing for §212 (a)(5)(c) subject cases. TSC has reaffirmed its prior policy of issuing Requests for Evidence (RFEs) on §212 (a)(5)(c) subject I-485 cases where the I-485 was initially filed without the VisaScreen. The Service Centers will no longer extend an RFE in cases lacking a VisaScreen. Should the VisaScreen be unattainable before the RFE is due, the I-485 would be denied, potentially putting the applicant out of status.Jon Eric Gaurd.
